These Terms of Use (“Terms”) govern your access to and use of the websites, pages, and online services that link to these Terms, including utopiahomestaging.com (the “Site”), which is owned and operated by Utopia Home Staging, LLC (“Utopia,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Who We Are
Utopia provides luxury home staging and related consulting services in and around Las Vegas, Nevada. Information on the Site may describe services, packages, consults, and examples of work product; however, the Site itself does not create a client relationship unless and until we mutually agree in writing (including through an accepted proposal/contract).

2) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date reflects the latest revision. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
3) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. By using the Site, you represent you meet this requirement.
4) Permitted Use and Prohibited Conduct
You may use the Site for lawful purposes and in accordance with these Terms.
You agree not to:
- Copy, scrape, reverse engineer, or attempt to extract source code or non-public data from the Site
- Interfere with the Site’s operation, security, or performance (including by introducing malware)
- Use the Site to transmit unlawful, defamatory, or infringing content
- Misrepresent your identity or affiliation
- Use the Site in any way that violates applicable laws or regulations
5) Intellectual Property
The Site and all content on it (including text, graphics, logos, photos, videos, designs, and compilations) are owned by Utopia or licensed to us and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal or internal business purposes. No other rights are granted.
6) Testimonials, Examples, and Portfolio Content
The Site may include testimonials, case studies, and before/after examples. These reflect individual experiences and project conditions and do not guarantee that you will achieve the same or similar results. Market outcomes are influenced by numerous factors outside of our control.
7) No Real Estate, Legal, or Financial Advice
Utopia is a staging and design services provider. Content on the Site is provided for general informational purposes and is not real estate brokerage advice, legal advice, financial advice, or a substitute for professional guidance tailored to your situation.
8) Estimates, Consultations, and Purchases
a) Requests and Estimates
Forms on the Site (including estimate requests) are provided for convenience. Submitting a request does not guarantee availability, pricing, or acceptance of a project. Any pricing or scope discussions remain non-binding until confirmed in a written proposal/contract.
b) Consultations and Scheduling
The Site may allow you to schedule and/or pay for consultations through a third-party scheduling/checkout platform (“Scheduling Provider”). Your booking may be governed by additional terms and policies presented at checkout(including cancellation/rescheduling terms). If there is any conflict between those checkout terms and these Terms, the checkout terms control for that transaction.
c) Payments
Payments may be processed by third-party payment processors. We do not store your full payment card details. You agree to provide accurate billing information and authorize charges you submit.
d) Consultation Policy: No Refunds; Credits; Same-Day Cancellations
All paid consultations are non-refundable.
If you cancel with advance notice, Utopia may, at its discretion, issue a credit to your account for future use (credit application and expiration, if any, will be communicated at the time it is issued).
Same-day cancellations (cancellations made on the day of the scheduled consultation) result in forfeiture of the paid consultation fee, and no credit will be issued.
Utopia may also treat missed appointments (“no-shows”) as same-day cancellations.
9) User Submissions
If you submit information or materials through the Site (e.g., messages, property details, photos, documents, links, or other content) (“Submissions”):
- You represent you have the rights to submit them and they do not violate any law or third-party rights.
- You grant Utopia a limited license to use Submissions solely to respond to your inquiry, provide requested information, evaluate your project, and deliver services.
10) Third-Party Links and Services
The Site may link to third-party websites or services (including social media and Scheduling Providers). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
11) Disclaimer of Warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTOPIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTOPIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTOPIA’S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE SHALL NOT EXCEED $100.
(Some jurisdictions do not allow certain limitations; in those jurisdictions, these limits apply to the greatest extent permitted.)
13) Indemnification
You agree to defend, indemnify, and hold harmless Utopia and its owners, employees, contractors, and agents from and against claims, liabilities, damages, judgments, and expenses (including attorneys’ fees) arising out of or relating to your use of the Site, your Submissions, or your violation of these Terms.
14) Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules.
15) Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
a) Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site (each, a “Dispute”) will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, except as stated below.
b) Location and Procedure
The arbitration will take place in Clark County, Nevada, unless the parties agree otherwise. The arbitrator will have authority to award any relief that a court could award on an individual basis.
c) Injunctive Relief
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to preserve the status quo or prevent irreparable harm, pending arbitration.
d) Class Action Waiver
YOU AND UTOPIA AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
e) Time Limit
Any Dispute must be brought within the time allowed by applicable law.
